Mobile Banking Agreement › Diamond Bank – The Electronic Funds Transfer Act governs transactions initiated through online banking. As the use of online banking services grows, this regulation will manage your rights. When you opened your account, you were informed of the provisions of this Act. Customer acknowledges that they have been told that transfers from savings or money market accounts initiated by telephone, electronic, or other pre-authorized means are limited to six per month under Federal Regulations.

The Internet Banking ID assigned to you by Diamond Bank (which you can change online) and the Password you choose online is in charge of account security. You agree to keep your Internet Banking ID and Password secure and indemnify the Bank against unauthorized use. You own and are responsible for the information you download. After 4:00 p.m. Central Time, a request for a fund transfer made through Internet Banking will be posted the next business day. Except for Saturday, Sunday, and all federal holidays, we are open every day of the week. Transfers between accounts are permitted only if funds are available following the Bank’s Funds Availability Policy. By using Online Banking, you agree to the terms and conditions of the Service. When you first opened your account, you were given Regulation E and Regulation DD disclosures. By submitting this application, you agree to all of Diamond Bank’s terms and conditions.

You authorize Diamond Bank to post payment transactions from the Online Bill Payment Service generated by a personal computer to the accounts listed on your online banking account. You recognize that you have complete control over your budget. If you decide to stop using the Service at any time, you must notify Diamond Bank in writing. You acknowledge that you have read and accepted all of the terms and conditions of Internet Bill Payment by using it.

You acknowledge that payments may take up to 7 days to reach the vendor and be sent either electronically or by check. Diamond Bank is not responsible for any service fees or late fees incurred by you. You also acknowledge that you are liable for any loss or penalty incurred due to insufficient funds or other conditions that prevent funds from being withdrawn from your account.

Mobile Banking

We will make reasonable efforts to keep the Service available to you at all times. For routine or emergency system maintenance, the Service may be unavailable for short periods. We will make every effort to schedule maintenance during off-peak hours. Furthermore, access to the Service may be disrupted due to circumstances beyond our control, such as internet outages. We will make every effort to restore the Services as soon as possible. We cannot guarantee that the Service will always be available to you. We reserve the right to terminate this Service at any time. If we decide to stop providing the Service, we will give you reasonable advance notice.

Diamond Bank Does not Charge a Fee for Its Service

At this time, Diamond Bank does not charge a fee for this Service. The Service may be set a price in the future. Diamond Bank reserves the right to change the fees for using the Service at any time, as described above in the section titled “Acceptance of these Terms.”

You must provide your hardware and software to use the Service. Unauthorized tracking or other manipulation of your hardware and software may be possible thanks to “spyware” or other malicious code. We are not liable for informing you of the existence or potential consequences of malicious code, and you use your hardware and software at your own risk. We cannot guarantee that the Service will work on all wireless devices. You are responsible for any wireless service provider charges incurred while using the Service.

We reserve the right to take any action necessary to protect our systems and information, including denying users of the Service access. We will make commercially reasonable efforts to secure the Service to prevent unauthorized access and malicious code, such as a computer virus, from being introduced. However, no security system is impenetrable, and despite our best efforts, the Service’s security may be jeopardized or malicious code introduced by third parties. If your information is the subject of a security breach, we will notify you as soon as possible, as required by law.

The terms and conditions of the deposit agreement for those accounts, as well as the terms and conditions for internet banking, apply to the accounts you access through the Service.
